1. Acceptance of Terms

By accessing or using the Arth Capital website (arthcapital.co.in) and our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Nature of Services

Arth Capital is an AMFI Registered Mutual Fund Distributor (ARN-186247). We are NOT a SEBI Registered Investment Adviser (RIA). Our services include:

  • Mutual fund distribution services (Regular plans)
  • Financial goal planning and guidance
  • Insurance distribution advisory
  • Retirement planning consultation
  • Educational content on personal finance

Our services do not constitute "Investment Advice" as defined under SEBI (Investment Advisers) Regulations, 2013.

3. Eligibility

Our services are available to Indian residents who are 18 years of age or older with a valid PAN card and are eligible to invest in mutual funds as per applicable Indian regulations.

4. Investment Risks

All mutual fund investments are subject to market risks. The NAV of schemes may go up or down based on market conditions. Past performance is not indicative of future returns. Investments in equity markets carry higher risk and volatility compared to debt instruments.

5. No Guarantee of Returns

Any return figures, projections, or estimates provided are indicative only, based on historical data, and are not guaranteed by Arth Capital or any Asset Management Company.

6. Client Responsibilities

  • Provide accurate and complete information for KYC and account purposes
  • Maintain confidentiality of login credentials to the investor portal
  • Review all scheme-related documents (SID, SAI, KIM) before investing
  • Notify us promptly of any changes to contact information or financial circumstances
  • Not misuse or share your investor portal access with third parties

7. Fees and Commissions

Arth Capital earns commissions from AMCs for distributing Regular plan mutual funds. These commissions are embedded in the expense ratio and do not involve any direct charge to you. Clients choosing Direct plans do not pay distributor commissions. Full commission disclosure is available on request.

8. Intellectual Property

All content on this website — text, graphics, logos, images, and software — is the property of Arth Capital and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Limitation of Liability

Arth Capital and its officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services or website, including any investment losses, to the maximum extent permitted by applicable law.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Raipur, Chhattisgarh. Parties agree to attempt resolution through mediation before initiating legal proceedings.

11. Amendments

We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms. We will notify registered clients of material changes via email.
